Terms and Conditions 2024

Please read the following Terms and Conditions carefully, as by booking our services you are expressing your acceptance:

These General Conditions are intended to regulate the terms and conditions of the provision of services by Surf Mama, located at Largo de Mariana, 7, in the town of Peniche, together with the service form and other associated elements

Cancellation Policy:

When you make a reservation for a unique experience, you are making a significant decision. It is crucial to understand that, once a service has been booked, that space becomes unavailable to other potentially interested parties. In the event of a cancellation, notification must be made by e-mail, subject to the following conditions

Cancellation up to 7 days before the class or other activity: In the event of cancellation up to 7 days before the class or other activity, a fee equivalent to 50% of the value of the activity will apply.
Cancellation up to 24 hours before the lesson or other activity: In the event of cancellation within 24 hours of the scheduled lesson time or in the absence of the client, no refund will be given.


Cancellation procedures

To cancel a lesson, please contact our customer service team by phone/WhatsApp (+351 934423648) or by e-mail (booking@surfmama.pt). Kindly provide the details of your booking, including the date and time of the lesson, along with your name and contact information. Our team will confirm the cancellation and process any refunds, as applicable.

Payment Methods
For advance online bookings, we require payment of 30% of the total amount by bank transfer. The total amount must be paid on the day of the class or service. Bank fees are the responsibility of the client.

Inherent Risks of Surfing

The customer acknowledges the inherent risks associated with surfing. By participating in lessons and related activities, the customer understands the possibility of injury. In the event of an accident or injury during lessons, no refund will be made.



Insurance and Liability

Surf Mama School has liability and personal accident insurance, as required by Portuguese law. However, clients are responsible for their own medical costs in the event of an accident or injury, as compulsory insurance may not cover all forms of medical assistance.



Accidents Before, During and After Lessons

Surf Mama School assumes no responsibility for accidents occurring before or after lessons, as well as during transportation in Surf Mama School vehicles.



Responsibility for Equipment

By providing equipment for surf lessons, Surf Mama School guarantees that all equipment is in proper condition. Responsibility for the maintenance and upkeep of the equipment lies with the customer, who must return it in the same condition as provided. Damage or loss of equipment will result in corresponding charges.



Driving during the lesson

During the lesson, it is imperative that customers follow all the surf instructor's instructions, avoiding any behavior that disturbs other participants or jeopardizes the safety of the lesson. Surf Mama School reserves the right to exclude any client who does not comply with these terms, without the right to a refund.



Substance Influence and Participation

Participation in surf lessons under the influence of alcohol or drugs is prohibited. Suspicion of such influence by the instructor may result in the client being excluded from the lesson, without the right to a refund.



Medical Condition

The client declares that he/she has no medical condition that prevents him/her from participating in surf lessons and other services provided by Surf Mama School.



Instructor Qualification and Safety

Surf Mama School instructors are certified and regularly attend safety, first aid and lifeguard courses in accordance with Australian and European standards. We carefully choose surf spots according to the level of the participants, minimizing the risk of accidents and injuries.


Surf conditions

Surf Mama School recommends and informs about the expected surf conditions, but is not responsible for bad conditions. Even in unexpected situations, the lesson will be considered to have taken place, with no right to a refund or repetition.

Weather conditions are beyond our control, and we cannot guarantee ideal surfing conditions at all times. In situations of unfavorable conditions, we will do our best to adjust the schedule. If an instructor deems the conditions unsafe, lessons will be canceled without refund and a new date will be sought. The safety of the participants is our priority, and we thank you for your understanding.

Image capture

During activities, Surf Mama School may film or photograph clients for use on social networks, websites or promotional materials.


Term of Responsibility

Before the first lesson or rental, the client must sign a disclaimer.

Communications

Notifications regarding the service may be sent by e-mail, SMS or telephone contact. The user agrees to receive communications to the e-mail address indicated in the order process.

Complaints

Contractual disputes may be submitted to legally constituted arbitration or mediation mechanisms. Complaints must be submitted to Surf Mama's systems within a maximum of 30 days of the User becoming aware of the facts.
